The terms on which we sell to you. Written to be read, not to be survived.

Before you trade. These policies are written to reflect UK consumer and data-protection law and are ready to use once you insert your company number, VAT number, registered address and payment provider. They are not legal advice. Have a solicitor review them against your actual operations before you take your first order.

1. Who we are

We are required to give you this information under the Companies Act 2006 and the Electronic Commerce (EC Directive) Regulations 2002.

2. These terms

These are the terms on which we sell goods to you. Please read them before placing an order. By placing an order you confirm that you accept them. If you do not accept them, please do not order.

We may amend these terms from time to time. The version that applies to your order is the version published on this site at the moment you place it. We recommend you keep a copy.

3. How a contract is formed

  • Placing an order is an offer to buy. It does not create a contract.
  • We will send an acknowledgement of your order by email. This is not an acceptance.
  • A contract comes into existence only when we send you a dispatch confirmation, or, for made-to-order pieces, when we confirm that we have begun cutting.
  • If we cannot accept your order — because the piece is sold out, because we have identified a pricing error, or because we cannot verify your details — we will tell you and will not charge you. If we have already taken payment we will refund it in full.

4. Prices and payment

  • Prices are shown in pounds sterling and include UK VAT at the prevailing rate.
  • Delivery charges are shown separately and are added at checkout. You will always see the total price, including delivery and any other charges, before you pay.
  • Orders delivered outside the United Kingdom may attract import duty and local taxes. These are charged by the destination country, are the recipient's responsibility, and are not collected by us.
  • Payment is taken through a third-party payment provider. Crimson Luis does not receive or store your full card details.
  • If a price is obviously wrong and you could reasonably have recognised it as an error, we are not obliged to supply at that price. We will contact you before proceeding.

5. Delivery and risk

  • Delivery options, costs and estimated timescales are set out on our delivery page.
  • Unless we agree a specific date with you, we will deliver without undue delay and in any event within 30 days of the contract being formed.
  • Goods remain at our risk until they are delivered to the address you gave us, or to a person you have nominated to receive them.
  • Ownership passes to you once we have received payment in full.
  • If nobody is available and the goods cannot be left safely, our carrier will leave a card and attempt redelivery. If goods are returned to us undelivered after failed attempts, we will contact you to arrange redelivery, which may be chargeable.

6. Your legal rights over the goods

We are under a legal duty to supply goods that conform to this contract. Under the Consumer Rights Act 2015 the goods we supply must be:

  • of satisfactory quality;
  • fit for any particular purpose you made known to us before ordering; and
  • as described, and matching any sample or model you were shown.

If they are not, you may have the right to reject them within 30 days of delivery for a full refund, or to ask for a repair or replacement, and in some cases to a price reduction or a final right to reject. 7. Cancelling and returning

Your right to change your mind, the exceptions to it, and our own extended 30-day policy are set out in full in our returns and refunds policy, which forms part of these terms.

8. Alterations and aftercare

We offer one complimentary alteration per garment within twelve months of purchase, and free replacement buttons and clasps for the life of the garment. These are contractual promises we make voluntarily; they are in addition to, and do not restrict, your statutory rights.

9. Accounts and acceptable use

  • You must give accurate information when ordering, and keep any account credentials confidential.
  • You must not misuse the site: no attempts to gain unauthorised access, no introduction of malicious code, no scraping for commercial resale of our content.
  • We may suspend or refuse service where we reasonably suspect fraud or misuse.

10. Intellectual property

All content on this site — including text, photography, illustration, the Crimson Luis name, marks and garment designs — belongs to Crimson Luis Ltd or is used under licence. You may view and print pages for your own personal use. You may not reproduce, distribute or use them commercially without our written permission.

11. Our liability

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the goods.

Where we are liable, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for losses that were not foreseeable, or for losses arising from your use of the goods for a business purpose — we supply to consumers for domestic and private use.

12. Events outside our control

We are not liable for delay or failure caused by events beyond our reasonable control. If such an event occurs we will contact you as soon as possible, and where the delay is substantial you may cancel and receive a refund for goods not delivered.

13. Complaints and disputes

Please contact care@crimsonluis.co.uk first — most matters are settled quickly. We will acknowledge a complaint within one working day and aim to resolve it within ten. If we cannot resolve it between us, you may be able to use an alternative dispute resolution scheme; details of any scheme we belong to will be published here: [ADR SCHEME, IF ANY].

14. Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.

If any provision of these terms is found to be unlawful, the remaining provisions continue in force. A delay by us in enforcing a term does not prevent us from enforcing it later.
